A 51-year-old Del Rio man faces a felony charge after he was arrested in February for allegedly sexually assaulting a young girl on at last three occasions.
The arrested man was identified in court documents as Jose Felipe Martinez, 51, 418 E. Chapoy St.
Martinez has been charged with the offense of continuous sexual abuse of a young child or disabled individual, a first-degree felony, according to court documents.
Del Rio police became aware of the alleged assaults in late December 2021 when the girl’s mother spoke to medical staff at a United Medical Center clinic.
In an affidavit filed in the case, DRPD Detective James Biscaino reported DRPD Officer Homer Perez was dispatched to the United Medical Center, 1117 W. De La Rosa St., at 5:27 p.m. on Dec. 30, 2021, after police received a call about the sexual abuse of a child.
“Upon arrival, (I) made contact with the charge nurse, who advised (an adult female) was at the facility and had made an outcry of sexual abuse of her daughter, who was not on the scene,” Biscaino wrote.
Biscaino reported the woman, who was initially reluctant to speak to police, said her daughter claimed the sexual abuse had begun in 2011 when she was three or four years old. The woman also identified Martinez as the man her daughter claimed was her abuser.
Biscaino wrote the woman told him she had been unaware of the alleged sexual assaults until Dec. 20, 2021, when the mother of one of her daughter’s friends spoke to her about it. The woman said her daughter had told her friend about the alleged assaults two years ago while they were both attending sixth grade.
Biscaino wrote he scheduled a forensic interview of the victim on Feb. 3, and the girl told the forensic interviewer that she could recall three separate sexual assaults, beginning when she was three or four years old and continuing until she was about seven years old.
The girl also said she confided in two friends about the assaults while she was in the fifth grade. She said she also made an outcry to a third friend in the sixth grade.
Biscaino’s affidavit reads that the incidents began “on or about the first day of January, 2011 through Dec. 31, 2014.”
Biscaino obtained a warrant for Martinez’s arrest on Feb. 9 and executed the warrant on the same day. A spokesman for the DRPD said Martinez was arrested at his place of employment at the time, the GEO Correctional Facility.
Justice of the Peace Pct. 2 Antonio “Tony” Faz III set Martinez’s bond at $150,000.
