A Del Rio man faces two felony drug charges after police found marijuana allegedly packaged for sale and bulk containers of THC vape cartridges in his vehicle.
E’Sau D’Ray Burciaga, 21, whose residence address is listed as 304 W. Second St. on his arrest report, but as 309 W. Sixth St. on his court paperwork, was arrested at 4:58 a.m. on Sept. 27, according to a report released recently by the Del Rio Police Department. Burciaga was charged with the offenses of manufacture or delivery of controlled substance, Penalty Group 2 or 2A, greater than or equal to four grams, less than 400 grams, a first-degree felony, and of delivery of marijuana, a state jail felony, the report on his arrest shows.
In an affidavit filed in the case, DRPD Officer Homer Perez wrote he and other officers were dispatched to an area near the intersection of North Main Street and Cantu Road just after 4 a.m. on Sept. 27 after police received a report about a suspicious vehicle in a nearby parking lot.
Perez reported while en route another officer advised him she saw the suspicious vehicle stationary on North Main Street. The officer informed Perez she saw a man, later identified as Burciaga “unresponsive in the driver’s seat of the vehicle.”
Perez said when he approached the vehicle, a 2012 Ford Focus, he saw Burciaga in the driver’s seat with the vehicle transmission in drive and the ignition turned off. Perez said the other officer advised him the vehicle ignition had been on when she arrived.
“As I proceeded to place the vehicle transmission in park and began to assist Burciaga, Burciaga began to wake up and became responsive. While attempting to speak with Burciaga, I observed an open container of an alcoholic beverage in plain view, located in the center cup holder console and in arm’s reach. I advised Burciaga to step out of the vehicle and proceeded to detain Burciaga pending further investigation,” Perez wrote.
Perez reported he advised DRPD Communications of his observations and began a probable cause search of the vehicle.
“I began to search the driver side door, where I located a clear plastic baggie containing multiple separately packaged smaller baggies of a green leafy substance. (Another officer) assisted with the search and located additional baggies containing the green leafy substance in the center console within arm’s reach of the driver’s seat. The baggies located (by the second officer) had a written dollar amount, $10, on the baggies,” Perez wrote.
He reported the officer assisting him with the search also found $1,186 in U.S. currency, wrapped in rubber bands, in the center console of the car.
“I continued to search the vehicle and located multiple THC electronic vape cartridges. The THC cartridges were in bulk size containers, some in original packaging and some that had been removed from the bulk packaging,” Perez wrote.
He wrote based on the discovery of the individually wrapped baggies of green leafy substance, the THC electronic vape cartridges and the cash, he arrested Burciaga and transported him to the police station for processing.
Bonds totaling $105,000 were set in the two cases against Burciaga by Justice of the Peace Pct. 3 Pat Cole.
