A 42-year-old Del Rio man was arrested on a felony drunk driving charge Friday, police said.
Rurico Rodriguez, 501 W. Chapoy St., was arrested and charged with the offenses of driving while intoxicated with a child passenger younger than 15 years of age, a state jail felony, and of resisting arrest, search or transportation, a Class A misdemeanor.
Del Rio Police Department Cpl. Dulce Gonzalez said DRPD Officer Sara Hernandez was dispatched to Ajillo’s restaurant, 1750 Veterans Blvd., after police were asked to make a welfare check on a man in a vehicle at the drive-through.
“The caller advised that the driver of a white SUV with a black top had almost caused a motor vehicle accident, appeared to be impaired and was foaming at the mouth. The caller also advised there was a child passenger in the vehicle,” Gonzalez said.
Hernandez reported when she arrived outside the restaurant, which was closed, she located the vehicle matching the caller’s description and approached the passenger side of the SUV, noticing there was an unrestrained child inside.
“She made contact with the driver and asked the driver why he was at that location due to the fact that the restaurant was closed. The driver appeared disoriented, had a hard time keeping his eyes open and spoke very slowly,” Gonzalez said.
Hernandez reported the driver was still foaming at the mouth, and she ordered him out of the vehicle.
The officer said the driver did not fully comply with her commands and began to resist her by pulling away when she attempted to frisk him.
“Another officer and a DPS trooper arrived on scene and assisted her. The man was handcuffed, and an EMS unit was called, and the man was transported to Val Verde Regional Medical Center for further evaluation,” Gonzalez said.
The man was subsequently arrested and taken to the police station for booking and processing.
