A man was arrested and charged with felony assault after he allegedly choked a woman during an argument, police said.
David Rodriguez, 28, 307 Marshall Smith Drive, was arrested at 12:32 a.m. on July 10 and was charged with assault impeding breathing-family violence, a third-degree felony, according to a report released recently by the Del Rio Police Department.
In an affidavit filed in the case, DRPD Officer Karina Palacios reported she was dispatched to 307 Marshall Smith Drive at 11:52 p.m. on July 9 “for a report of a husband strangling (a woman).”
“Upon arrival, contact was made with the victim, who was waiting outside. . . The female stated that . . . David Rodriguez had strangled her three times,” Palacios wrote.
The woman told Palacios Rodriguez had “grabbed her by the neck three separate times” during the night of July 9. Palacios also reported the woman had visible bruises on her neck “consistent with the size of fingers.”
“(The woman) stated that the first time she got grabbed by the neck by Rodriguez she was in the kitchen (and) she then attempted to get away from Rodriguez by retreating to her bedroom. (The woman) claimed that Rodriguez then followed her into the bedroom. (The woman) was then grabbed a second time by Rodriguez and was unable to breathe for about 15 seconds,” Palacios wrote.
Palacios reported the woman also told her that Rodriguez grabbed her by the neck a third time and “slammed her head into the bedroom wall.”
“Rodriguez told officers that he had only grabbed (the woman) by the neck once and pushed her into the bedroom wall,” Palacios wrote.
Palacios reported she arrested Rodriguez on the assault charged and transported him to the police station for processing.
Justice of the Peace Pct. 3 Pat Cole set a bond of $10,000 in the case.
