NEWS — Man charged with felony drug possession

A man accused of carrying a baggie of methamphetamine was arrested and charged with felony drug possession, police said.

Cesar Treviño, 39, 131 Cora Ave., was arrested about 1 a.m. on Dec. 10, according to a report released recently by the Del Rio Police Department. was charged with the offense of possession of a controlled substance, Penalty Group 1, greater than or equal to four grams, less than 200 grams, a second-degree felony, the report on his arrest shows.

In an affidavit filed in the case, DRPD Officer Ruben Lascano wrote he was patrolling an area near the intersection of East 15th Street and Veterans Boulevard at 1 a.m. on Dec. 10, “searching for a suspect vehicle in a ‘shots fired’ call for service.”

Lascano said he saw “a vehicle come to an abrupt stop, and a subject run from the driver’s side of the vehicle in the 800 block of East 15th Street.”

Lascano said as he neared the vehicle, he “recognized it from prior calls.”

“(I) observed a male subject, who (I) also recognized from prior calls for service, Cesar Treviño, coming from a covered carport area of apartments in the 800 block of East 15th Street. (I) immediately detected the odor of marijuana coming from Treviño’s person,” Lascano wrote.

Lascano said he told Treviño about the investigation that had brought him to the area and asked Treviño if he was in possession of any weapons. He said Treviño replied he was not and claimed he had come to the apartments in search of a mechanic.

“(I) asked Treviño for consent to search his outer clothing for weapons. Treviño allowed (me) to conduct a search of his outer garments. Upon patting down Treviño’s upper body, (I) could feel an unusual bulge under Treviño’s clothing. (I) asked Treviño to identify what (I) was feeling, and Treviño stated the bulge (I) was feeling was a zipper of the sweater he was wearing under a sports jersey. Treviño proceeded to lift his jersey and sweater to identify what (I) was feeling on his upper chest. Upon exposing a zipper, a white plastic bag (fell) from Treviño’s person,” Lascano wrote.

Lascano reported when he asked Treviño what was in the bag, Treviño replied he didn’t know and that the bag that had fallen out of his clothing didn’t belong to him.

Lascano said he handcuffed Treviño and told Treviño he was being detained while the substance in the bag could be identified.

“(I) opened the wrapped baggie, exposing a crystal-like substance. (I) field tested the substance and received a positive results for methamphetamine,” Lascano wrote.

He said he then arrested Treviño and transported him to the police department for processing.

Lascano said he weighed the substance in the baggie, and it weighed a total of seven grams. The officer said he charged Treviño with possession of a controlled substance, greater than or equal to four grams, less than 200 grams.

Justice of the Peace Pct. 1 Jesse James set bail in the case at $15,000.
