A 36-year-old Del Rio man has been charged with two felony assault offenses after trying to run over and then shooting another man outside a south-side convenience store Sunday morning.
Jose Antonio Diaz Alvarado, 421 W. Nicholson St., has been charged with the offense of aggravated assault with a deadly weapon, a first-degree felony, and with the offense of aggravated assault with a deadly weapon (vehicle), a second-degree felony, according to an affidavit filed in the case.
Alvarado is charged with assaulting Gustavo Barboza Jr., 43, in the parking lot outside the Minits #115 convenience store, 620 Las Vacas St., about 11:30 a.m. Sunday.
The filed affidavit, released to The 830 Times Monday afternoon by Justice of the Peace Pct. 3 Pat Cole, reads that on Sunday, April 10, at 11:41 a.m., Del Rio Police Department officers were dispatched to 620 Las Vacas St., for a fight in progress.
When officers arrived at the store, they reported they found Barboza outside, suffering from “a gunshot wound to the left side of his hip area.”
An emergency medical services team from Val Verde Regional Medical Center arrived at the store and transported Barboza to the emergency room at the hospital. Barboza was later flown to University Hospital in San Antonio by medical helicopter for further treatment.
His condition was not known as of late Monday afternoon.
The affidavit on file in the case reads that a police officer making his way to the convenience store stopped “the suspected actor vehicle,” described as a red Honda Civic with Texas license plates as the car was leaving the scene of the shooting.
A DRPD incident report indicates the Honda Civic was stopped outside Alvarado’s home at 421 W. Nicholson St.
Alvarado was detained and taken into police custody. A second person detained after the Civic was stopped was later released and has not been charged with any criminal offense, a spokesman for the city said Monday.
The affidavit notes that DRPD Detective Darian Castro “reviewed the (convenience store) surveillance (camera) footage, which showed Alvarado attempting to run Barboza over with his vehicle.”
“Alvarado then exits his vehicle, holding a firearm in his right hand. Alvarado proceeds to discharge the handgun, striking Barboza on the left side of his hip,” the affidavit reads.
It continues, “During further investigation, Alvarado confessed to the handgun used to be inside his vehicle. The handgun was recovered and found to be a black Glock 21 Gen 4 auto .45 caliber. (The) handgun was recovered and submitted into evidence.”
Alvarado was magistrated by Cole at 10:28 a.m. Monday. Bonds totaling $150,000 were set in the cases against him.
