Allan Wayne Stewart, 51, of Del Rio, was charged with murder and unlawfully carrying a gun after a fatal shooting outside a north Del Rio convenience store Sunday night.

On November 3rd, 2024, at approximately 7:31 P.M.  Del Rio Police Department responded to a call for service for shots fired at 2100 Veterans Blvd., Stripes Convenience Store. The caller reported the actor was still on scene and was standing next to a white in color four- door sedan.

Upon arrival, police saw the male victim sitting on the pavement with his back resting against the wall of the store. The male victim was unresponsive and was bleeding from his mouth and ear. EMS arrived on scene and transported the male victim to Val Verde Regional Medical Center where he succumbed to his injuries.

At the scene, police addressed a group of male subjects asking who had shot the male victim. A male identified as Allan Wayne Stewart; 51 yrs. of age answered, “I shot him.” Stewart told police he was assaulted by the male and shot him in self-defense.

In a post Miranda Warning Interview, Stewart told police he had a verbal dispute with the male subject. Stewart stated the dispute escalated to a physical altercation causing Stewart to discharge his weapon at the male. Police are still investigating the cause of the dispute.

Stewart was arrested for the offense of Unlawful Carrying of Weapons and Murder.  Stewart was transported to the Police Station for processing and was later transported to GEO Correctional Facility.

A search warrant was obtained to enter Stewart’s vehicle where the firearm was located. The firearm was collected and submitted as evidence.
