The Del Rio Middle School band director was arrested earlier this week for allegedly having sex with a high school girl, sheriff’s office investigators have confirmed.
Sheriff Joe Frank Martinez and VVSO Lt. Gina Garcia, who heads the sheriff’s office criminal investigations division, on Friday told the 830 Times patrol deputies arrested Victor Carrillo, 23, 135 Dogwood St., on Monday after Carrillo turned himself in at the sheriff’s office.
Carrillo has been charged with one count of the offense of improper relationship between educator and student, a second-degree felony, Garcia said.
According to an affidavit in court documents on file in the case, sheriff’s office investigators learned of the alleged incident on Jan. 10, when an officer with the San Felipe Del Rio Consolidated Independent School District Police Department spoke with VVSO Investigator Shaun Davis.
The school police officer told Davis a male student had informed the district’s early college principal of “another student having sexual intercourse with a school employee.”
The student was identified as a female enrolled at Del Rio High School, and the school employee was identified as Carrillo, who was at the time was employed as the band director at Del Rio Middle School.
Davis in his affidavit wrote that the DRHS principal interviewed the student in the company of her parents, but added at the time she denied having sex with Carrillo.
He wrote that the parents later continued questioning their daughter at home, and she “made an outcry to them about having sexual intercourse with Carrillo out by Lake Amistad inside his vehicle.”
The parents told Davis the incident occurred sometime between Oct. 23 and Oct. 27, 2023.
Davis wrote Garcia and VVSO Investigator Carolina Zavala also interviewed the young woman, and she admitted to them she had “developed a relationship” with Carrillo during October 2023. During the interview, the young woman described meeting Carrillo in the Plaza Del Sol Mall parking lot and driving out to the lake with him, where she claims they had sex in the backseat of his car.
The young woman told investigators “she no longer wanted to have sexual intercourse with him and stopped it, and Carrillo returned her to the mall and dropped her off.” The young woman said Carrillo also “told her he was sorry and to not tell anyone because he would be fired from his job.”
Davis obtained an arrest warrant based on the information he and other investigators had gathered, which was signed by 83rd Judicial District Judge Robert E. Cadena on Jan. 10.
Garcia said Carrillo was arrested on the warrant at the sheriff’s office when he turned himself in on Monday, Jan. 15. She said he was released on bond the following day.
